1. Acceptance of Terms

By accessing or using next circ ("the Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, you may not use the Service. We may update these Terms from time to time, and continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

2. Description of the Service

next circ provides a basketball coaching directory and related tools, which may include:

• Search and browse access to D1 and JUCO coaching staff information
• Limited preview access for non-subscribers on selected pages
• Premium features such as full directory access, search within browse, downloads, and change history
• News articles, job listings, email templates, and account management tools

We may add, modify, or remove features at any time.

3. Accounts

You must provide accurate registration information and keep your account credentials secure. You are responsible for all activity that occurs under your account. You must be legally able to enter into a binding agreement to use the Service. We may suspend or terminate accounts that violate these Terms or present a security risk.

4. Subscriptions & Billing

Paid access to premium directory features requires an active subscription. Subscriptions are billed through Stripe on a recurring basis unless canceled. By subscribing, you authorize us and Stripe to charge your selected payment method for the applicable plan.

• Subscription pricing and plan details are shown at checkout or on the pricing page.
• You may cancel your subscription from your profile page.
• If you cancel, you generally retain access until the end of the current billing period unless otherwise stated.
• We may change pricing or plan features with reasonable notice where required.

5. Refund Policy

All sales are final. No refunds will be issued once directory data has been accessed. By subscribing, you acknowledge and agree to this policy. If you cancel your subscription, you will retain access until the end of your current billing period. No partial or prorated refunds will be provided for early cancellations.

6. Acceptable Use

You agree not to:

• Use the Service for unlawful, fraudulent, or abusive purposes
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Scrape, crawl, harvest, or bulk extract directory data except through authorized product features such as the provided download tool
• Redistribute, resell, republish, or commercially exploit directory data without our written permission
• Interfere with or disrupt the integrity, security, or performance of the Service
• Misrepresent your identity or affiliation when contacting coaches or using the Service

7. Account Sharing & Suspension

Each subscription is for a single individual user only. Sharing account credentials or allowing multiple people to access the Service through one account is prohibited.

We monitor for suspicious activity, including logins from multiple devices or locations inconsistent with single-user usage. If we determine that an account is being shared or abused, we may immediately suspend or terminate the account without refund and without prior notice.

8. Directory Data Disclaimer

Directory information is compiled from publicly available sources and official athletics pages and is provided for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of any listing. Coaching staff information may change without notice. You are solely responsible for how you use contact information and for complying with applicable laws, school policies, and anti-spam rules when reaching out to coaches.

9. Intellectual Property

The Service, including its design, branding, software, curated directory compilation, articles, and related content, is owned by next circ or its licensors and is protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or internal business use in accordance with these Terms. You may not copy, reproduce, or exploit the Service or its content beyond what is expressly permitted.

10. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, next circ and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, arising from or related to your use of the Service.

Our total aggregate liability for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

11. Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted by a single arbitrator. The arbitrator's decision shall be final and binding.

You agree that arbitration shall be conducted on an individual basis and not as a class action or collective proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against next circ.

Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.

12. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms, create security or legal risk, or if we discontinue all or part of the Service. You may stop using the Service at any time. Sections that by their nature should survive termination will continue to apply.
