1. Acceptance of Terms

By accessing or using next circ ("the Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the Service. We reserve the right to update or modify these terms at any time, and your continued use of the Service constitutes acceptance of those changes.

2. Refund Policy

All sales are final. No refunds will be issued once directory data has been accessed. By subscribing, you acknowledge and agree to this policy. If you cancel your subscription, you will retain access until the end of your current billing period. No partial or prorated refunds will be provided for early cancellations.

3. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. next circ and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim. The information in our directory is collected from publicly available sources and is provided for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of any data.

4. Account Sharing & Suspension

Each subscription is for a single individual user only. Sharing your account credentials with others, or allowing multiple people to access the Service through a single account, is strictly prohibited.

We actively monitor for suspicious activity, including logins from multiple devices or locations inconsistent with single-user usage. If we determine that an account is being shared, we reserve the right to immediately suspend or terminate the account without refund and without prior notice. Repeated violations may result in a permanent ban from the Service.

5. Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted by a single arbitrator, and the decision of the arbitrator shall be final and binding.

You agree that any arbitration shall be conducted on an individual basis and not as a class action or collective proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against next circ.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.

6. Acceptable Use

You agree not to use the Service for any unlawful purpose or in a manner that could damage, disable, or impair the Service. You may not attempt to gain unauthorized access to any portion of the Service, scrape or bulk-download directory data beyond what is provided through the authorized download feature, or redistribute directory data to third parties.
